SECURITY DEPOSIT / INDEMNITY
If the equipment is picked up by the customer, a valid credit card will be required at the time of the pick up.
This credit card will be charged in the event of damage to the equipment or if the equipment is lost or stolen.
If a security deposit is collected, this deposit will be returned to the customer at the termination of this rental agreement,
subject to the option of the company to apply it against rental amount or any rental damages.
Additionally, failure to return equipment on time, in good, clean condition shall result in the loss of said security deposit and or charges to the valid credit card.Any amounts refundable to the customer shall be paid once the rental is check for damage.
Indemnity: Renter listed above will assume all liability for the use of this rental equipment and for any third parties who will be near equipment while in possession of Renter. The renter, guests, and any other party to this rental agreement hereby releases Christmas Displays INC., and its sister company Music City Margarita and any of their employees, agents and owners from any liability relating to this equipment rental.
Christmas Displays, Inc. / Music City Margarita does not distribute or sell liquor.
Any use of liquor in this machine is the responsibility of the renter and not Christmas Displays, Inc. / Music City Margarita.
Renter assumes all responsibility pertaining to the use of liquor and releases Christmas Displays, Inc. / Music City Margarita from any liability associated with the use of alcohol, beer, wine and any other liquor.
EQUIPMENT OPERATION AND SAFETY
Renter understands that this equipment is of commercial grade and care is to be taken in providing safety to all guests near and around the machine at all times. No one under the age of 21 is allowed to operate this equipment at any time. Renter will use the rented equipment in a safe manner and in full compliance as directed by Christmas Displays, Inc. / Music City Margarita. Renter acknowledges that he/she received instruction for operation and care of machine and assumes all safety liability
RISK OF LOSS OR DAMAGE
Renter assumes all responsibility and risks of loss or damage to the equipment from any cause and agrees to return it to the Company in good, clean condition, as received from the Company. Renter will be responsible for full value of damage, regardless of who caused the damage while equipment was in their possession.
IMPORTANT:DO NOT LAY THE MACHINE ON ITS SIDE FOR ANY REASON, TRAVEL OR OTHERWISE. MACHINE MUST REMAIN UPRIGHT AT ALL TIMES.
PLEASE ONLY USE "You Need A Drink" OR Music City Margarita MIXES IN OUR MACHINES!
IF YOU DECIDE TO NOT USE OUR MIX, YOU MUST USE A MIX THAT IS DESIGNED FOR FROZEN DRINK MACHINES AND ACCEPT THE LIABILITY IF YOUR MIX DAMAGES THE MACHINE AND AGREE TO PAY FOR ANY REPAIRS NEEDED UP TO THE REPLACEMENT COST OF THE MACHINE.
THE USE OF ANY OTHER MIX PRODUCTS OR ADDITIVES TO OUR MIX SUCH AS PULP PRODUCTS
(THIS INCLUDES BUT IS NOT LIMITED TO: LIMES, LIME JUICE, LEMONS, LEMON JUICE, ORANGES, ORANGE JUICE) WILL RESULT IN AN ADDITIONAL CLEANING FEE.
Christmas Displays, Inc. / Music City Margarita RESERVE THE RIGHT TO CHARGE ANY REPAIR CHARGES AS A RESULT OF USING ANY OF THE ABOVE.
MACHINE MUST BE PLUGGED INTO A DIRECT-WIRED A/C SOURCE.
NO GENERATORS OF ANY KIND ALLOWED!
* Any violation of any of these rules will result in the customer being responsible for all repair charges up to the price of a new replacement machine.
Machine will be tested upon return and violators of this policy will be charged immediately for repairs.
TERMS AND CONDITIONS
Renter agrees to return equipment on a timely basis and make equipment available to Christmas Displays, Inc. / Music City Margarita representative as agreed. Failure to return the equipment on a timely basis will result in additional rental charges at the rates set forth in this agreement (If you are late, we reserve the right to charge you $30 per hour late fee (to be charged in 1/4 hour increments). If the undersigned does not return the equipment within 48 hours of agreed rental expiration, the undersigned will be deemed to have taken the equipment without permission. Christmas Displays, Inc. / Music City Margarita shall be authorized to charge the undersigned for the following: a.) rental costs for 48 hours, b.) replacement costs, c.) re-ordering fee equal to 10% of the above costs and expenses. Additionally, a $50.00 service charge will apply to all returned checks.
In the event equipment is not returned, or there is an outstanding balance for goods and/or services Christmas Displays, Inc. / Music City Margarita is authorized to charge the undersigned’s credit card.
